DataCrazy Terms of Use & Anti-Fraud Policy (Prohibitions and Consequences)

I. Prohibited Activities and Content

DataCrazy expressly prohibits the use of its platform for any unlawful, unethical, or value-misaligned purpose. In particular, it is forbidden to use DataCrazy to send bulk messages (“blasts”) containing any of the following:

• Illegal Betting and Gambling: Promotion of betting houses, casinos, gambling or “bets” not authorized by law, including lotteries, raffles, sweepstakes, or other unregulated wagering schemes. Besides violating our policy, such activities generally contravene applicable laws and the WhatsApp platform’s own guidelines.

• Scams and Fraud: Fraudulent or misleading messages intended to gain undue advantage or cause harm to others. Examples include “your package was seized at customs, pay a fee to release it,” phishing attempts, fake charges in the name of legitimate institutions, deceptive promotions, and similar. These constitute abuse of the platform and may amount to criminal fraud or other consumer-related offenses.

• Illegal or Unlawful Content in General: Any use of DataCrazy to disseminate material not compliant with applicable laws—including messages that promote criminal activity, prohibited products/services, or any material that infringes third-party rights, violates public order, or our Terms of Use. Deceptive content, schemes, fictitious offers, or any message that mislead

s recipients will not be tolerated.

Note: These restrictions are aligned with WhatsApp Business and Meta official policies, which categorically prohibit using the API to facilitate real-money gambling, fraudulent schemes, or unsolicited “spam” messaging that deceives or harms users.

II. Monitoring and Abuse Identification

DataCrazy maintains a strict compliance posture and employs anti-fraud tools and procedures to identify misuse of the platform. All users should be aware that:

• Investigation of Indicators: Any indication of prohibited messaging as described above may trigger an immediate internal investigation. DataCrazy may collect evidence (such as sending logs, message content, registration data, IP addresses, etc.) to determine whether the Terms were violated. This information will be processed in accordance with our Privacy Policy, but may be used to enforce this Anti-Fraud Policy and to support account blocking or reporting to authorities, as described below.

• Platform Protection: Attempts to mask identity, bypass security mechanisms, or “evade” our detection systems constitute a severe violation. DataCrazy may take preventive measures if anomalous patterns are detected (e.g., high-volume blasts with suspicious content) to safeguard the integrity of the platform and other users.

Note: DataCrazy is not responsible for the content of messages sent by users, yet reserves the right to act when such messages violate these Terms or create legal risk for the company or third parties. Our priority is to ensure the platform is not used as an instrument for illegal or abusive activities, maintaining a safe and lawful environment.

III. Immediate Blocking and Disciplinary Measures

Users caught using the platform for any prohibited activity are subject to immediate blocking and sanctions. Measures DataCrazy may adopt in case of violation include, without limitation:

• Suspension or Termination Without Prior Notice: At its sole discretion, DataCrazy may temporarily suspend or permanently block the offending User’s access to the platform without prior notice. The severity of the conduct (for example, sending thousands of scam messages) may justify immediate blocking due to the potential harm involved. The account may be terminated permanently, preventing the User from using our services in the future. (This measure protects the community and is consistent with industry practices in which accounts are banned without notice for serious policy or legal violations.)

• Forfeiture of Amounts Paid and Financial Liability: Where an account is terminated for violation of these Terms, the User will not be entitled to a refund of any amounts already paid to DataCrazy. Any credits, subscriptions, or balances tied to the offending account will be forfeited due to the User’s breach. Moreover, DataCrazy reserves the right to seek compensation for damages caused to the platform or third parties due to misuse (e.g., damage to our reputation, legal or operational costs arising from the User’s unlawful conduct).

• Refusal of New Enrollment: At its discretion, DataCrazy may refuse new registrations or contracts from the same individual or organization connected to an account banned for misuse. Using straw persons, shell companies, or other artifices to return to the platform after a ban constitutes a violation of these Terms and will subject the responsible party to the same penalties herein.

• DataCrazy is under no obligation to provide backups, data exports, or any assistance to Users whose accounts are blocked due to prohibited activity. All messages, contacts, or records associated with the offending account may be retained for forensic analysis and, if applicable, provided to competent authorities. We may also notify partners (for example, WhatsApp/Meta API) of the User’s access termination, which can result in platform-level blocks within the WhatsApp Business API (e.g., banning the offending number or company from WhatsApp services). In short, the consequences of misuse are serious and may be irreversible—the User may lose access both to our platform and to associated messaging channels.

IV. Cooperation with Authorities and Legal Consequences

In addition to internal administrative measures, DataCrazy will actively cooperate with law enforcement and judicial authorities whenever there are indications that a User has leveraged the platform to promote potentially criminal activities. Specifically:

• Notification to the Public Prosecutor’s Office and Law Enforcement: In cases involving scams, fraud, promotion of illegal gambling, or any conduct that constitutes a crime or legal violation, DataCrazy may submit a formal report to the competent authorities. We maintain a communication channel with the Public Prosecutor’s Office (Ministério Público) and/or specialized police units, to whom we will provide pertinent information: the User’s registration data (name, CPF/CNPJ, contact details), access IP addresses, copies of messages that constitute the offense, logs with dates and times of blasts, among other possible elements. This collaboration enables authorities to investigate and take appropriate legal action against those responsible.

• Consent to Data Disclosure: By accepting these Terms, the User expressly agrees that DataCrazy may disclose their data and message content to authorities if suspected of engaging in prohibited conduct. In other words, the contractual duty of confidentiality is lifted in situations of criminal investigation or violation of these Terms, as permitted by law. This cooperation clause mirrors those adopted by other technology companies, whereby the user authorizes the provider to share personal information to help identify users engaged in unlawful acts.

• Legal Consequences for the User: Using DataCrazy to perpetrate scams or disseminate illegal activities may entail criminal and civil liability for the offending User. The information provided to authorities may support police inquiries and court proceedings for crimes such as fraud, identity falsification, computer-related offenses, crimes against the popular economy, gambling contraventions, among others under Brazilian law. The User may be investigated, prosecuted, and, upon conviction by competent authorities, subject to penalties that can include fines and imprisonment, depending on the severity of the offense. DataCrazy is committed to combating any criminal use of its platform and will fully cooperate with authorities to ensure offenders are identified and held accountable under the law.

Important: DataCrazy may proactively investigate suspicious activities and cooperate with law enforcement to hold offenders accountable to the fullest extent permitted. We will not hesitate to pursue appropriate legal avenues to protect our users, the community, and society at large from malicious practices. This includes complying with court orders, official requests from the Public Prosecutor’s Office, or formal investigative demands, as well as proactively reporting criminal conduct we detect.

V. User Agreement and Final Provisions

By using DataCrazy, the User acknowledges, agrees, and undertakes to fully comply with this Acceptable Use and Anti-Fraud Policy, as well as the platform’s general Terms of Use. The clauses above serve as an addendum to our Terms, and any violation constitutes a serious breach authorizing the punitive measures described herein. In summary:

• Individual Responsibility: The User assumes full responsibility for the content sent via DataCrazy and commits to using the platform solely for lawful and legitimate purposes. Any deviation may result in immediate sanctions.

• DataCrazy’s Right to Act: The User recognizes DataCrazy’s right to impose penalties, technically restrict platform access, and communicate with authorities in cases of suspected illegal activity—without such actions constituting a breach of confidentiality or contractual duty, given the exceptional nature of protecting the collective and preventing crimes.

• Acceptance of Terms: By proceeding with registration or use of the services, the User electronically agrees to this Policy. This comprehensive consent ensures that all DataCrazy customers are aligned with our compliance practices. If the User disagrees with any provision, they must refrain from using the platform.

• Updates and Public Disclosure: This Anti-Fraud Policy may be updated periodically by DataCrazy, and current versions will always be available on our website for public consultation. We will inform our user community about any significant changes. Frequent review of this section is recommended so everyone remains aware of the rules of use.

• If you have questions about this policy, you may contact our support/compliance team through DataCrazy’s official channel. We are available to provide any necessary clarifications. However, we reiterate that we will not make exceptions or tolerate abuse: our commitment to ethics and the law is non-negotiable. Bad-faith users intending to use the platform for malicious spam, scams, or illegal betting are strictly prohibited and unwelcome—they will be identified and banned.

• In sum, DataCrazy enforces zero tolerance for fraud, scams, and unlawful activities. Our goal is to protect the community and the business messaging market from practices that cause harm or operate outside the law. By agreeing to these Terms, you affirm that you stand on the right side—using DataCrazy responsibly, lawfully, and in alignment with our values of integrity and safety for all. VI. Clause – System Stability, Updates, and Third-Party Dependencies

8.⁠ ⁠System Stability, Updates, and Third-Party Dependencies

•8.1. Datacrazy is a platform that integrates with and depends on third-party services such as cloud providers, messaging APIs (including WhatsApp, Instagram, Facebook, among others), payment gateways, authentication services, databases, and other external infrastructures. Therefore, any instability, interruption, unavailability, or failure originating from these external services may partially or fully impact the platform’s operation, even if temporarily.

•8.2. The User acknowledges that such external instabilities are not directly controlled by Datacrazy and may occur for reasons such as: network fluctuations, cloud provider outages, technical or commercial limitations of external APIs, unexpected updates, corrective/emergency maintenance, among other factors beyond the company’s control.

•8.3. Datacrazy performs periodic corrective and evolutionary updates with the purpose of improving performance, security, features, and user experience. During or after these updates, temporary system instabilities may occur, which will be addressed with priority by the technical team.

•8.4. The User acknowledges and agrees that: a) no online system can guarantee full (100%) availability; b) instabilities may occur as a natural part of digital services; c) Datacrazy commits to acting diligently and promptly to restore full operation whenever necessary.

•8.5. Based on the above, Datacrazy cannot be held liable for losses, damages, or harm resulting from instabilities caused by third parties, external failures, or necessary updates, except in cases where the company’s sole fault is proven.

•8.6. By using the platform, the User fully accepts this operational condition and understands that service continuity depends, in part, on external structures beyond Datacrazy’s direct control.
